Definitions

Online Course means a course delivered by us in which you learn the course materials remotely.

Course Materials – the information provided by Kids4IT to accompany a course delivered as part of the Services, either on paper or in electronic format.

User – any person who visits the website kids4it.ro.

Client – an individual or legal entity that places an Order.

Products and Services – any product or service mentioned in the Order, which is to be provided by the Seller to the Client.

Order – an electronic document that serves as a form of communication between the Seller and the Client, through which the Client expresses their intention to purchase certain Products and Services and make payment for them.

Contract – an Order confirmed by the Seller, by which the Seller agrees to sell and deliver the Products and Services, and the Client agrees to purchase, receive, and pay for these Products and Services.

Disclaimer

Kids4IT does not guarantee that the website, the servers hosting it, or emails sent from [email protected] are free of viruses or other potentially harmful software components, that they are error-free, or free of omissions, defects, delays, or interruptions in operation or transmission, line failures, or any similar factors. Users access the site at their own risk, and Kids4IT is not liable for any direct or indirect damages caused by the use of or access to the site, or as a result of using the information provided on the site. Kids4IT is not responsible for errors or omissions that may occur in the preparation or presentation of materials on the site.

The information included on kids4it.ro is provided for informational purposes and made available in good faith from sources the Seller considers reliable. If any published article or other information falls under copyright law or related rights, the User is requested to notify the Seller at [email protected] so that appropriate legal measures can be taken.

Kids4it.ro reserves the right to cancel Orders for Products and Services displayed on the site due to technical errors, or if, as a result of technical errors, the prices shown are clearly incorrect or negligible for the products (prices that any reasonably knowledgeable buyer may consider clearly erroneous or negligible).

Any links to other websites are provided solely to improve information accessibility, and Kids4IT assumes no responsibility or liability for the content of these sites, or for the products or services promoted or sold through these sites.

Processing of Personal Data

The categories of personal data processed include: name and surname, gender, date and place of birth, civil status documents, phone/fax, address (domicile/residence), email, profession, workplace, professional training, family situation, economic-financial situation, information about owned assets, habits/preferences/behavior, image, voice, geolocation/traffic data.

When a User creates an account on kids4it.ro, they will receive commercial communications from Kids4IT only if they have given explicit consent by selecting the appropriate option.

Data collected regarding newsletters and alerts are confidential. Kids4IT may select the Users to whom newsletters and alerts are sent.

In accordance with Law no. 677/2001 for the protection of individuals regarding the processing of personal data and the free movement of such data, as amended, and Law no. 506/2004 regarding the processing of personal data and the protection of privacy in the electronic communications sector, Kids4IT is obliged to process the personal data provided by Users safely and only for the specified purposes.

The purpose of collecting personal data is: economic-financial management, advertising, marketing, publicity, statistics, electronic communications services, informing Clients about the status of their account on kids4it.ro, and updating Clients regarding the progress and status of their Orders.

By completing forms on the website, Users unconditionally accept that these data will be included in the Kids4IT database and processed by Kids4IT, its affiliates, and collaborators for the activities mentioned above, including, but not limited to, service providers for marketing, courier, and payment/banking services.

Clients are guaranteed the rights provided by Law no. 677/2001 regarding the protection of individuals in relation to personal data processing and the free movement of such data, including the right to information, the right to access data, the right to intervene, the right to object, the right not to be subject to an individual decision, and the right to appeal to the courts in case of violation of their rights. Clients have the right to request the total or partial deletion of personal data. Clients can exercise any of these rights by submitting a written, signed, and dated request to the Kids4IT headquarters.

Refusal to provide this data makes it impossible to fulfill Orders.

If a Client modifies their personal data through the forms on the website while Orders are in progress, the Orders will retain the data at the time the Order was placed, and product delivery will be based on the newly modified data.

Kids4IT does not request confidential information from its Users by any means (phone, email, etc.), such as bank account details or personal passwords. If a User discloses such information to third parties, they bear full responsibility for their actions. In such cases, the User cannot hold Kids4IT liable for any damage resulting from the disclosure.

Data Protection

a. The nature of the Services we provide means that we will obtain, use, and disclose (together, “Use”) certain information about you (“Data”). This statement sets out the principles governing our use of data. By purchasing the Services, you agree to this use.

b. When you register with us, you will be required to provide certain information, such as your contact details and demographic information. We will store this information and use it to contact you, provide details about the Services you have purchased, and otherwise as necessary during the normal delivery of the course.

c. We may also use the above data and similar information you provide in response to surveys to aggregate user profiles and, unless you click the relevant button in the registration form, to provide you with communications. We will not share personal data with anyone outside of Kids4IT.

d. To allow us to monitor and improve our Services, we collect certain aggregated information about you, including details about your operating system, browser version, domain name and IP address, the URL from which you came and accessed, and the parts of the site you visited.

e. We use information such as your user ID, session identifiers, and password to allow us to identify if you are using our services, to provide you with services, and to ensure that you have access to the relevant products. We only read cookies from the cookie file placed on your device through your web browser’s interaction with the website.

f. Our products may connect to third-party websites, and we are not responsible for their data policies or procedures or for their content.

g. Kids4IT strives to take all reasonable measures to protect your personal data, including the use of encryption technology, but cannot guarantee the security of any data you disclose. You accept the inherent security risks of being online and conducting transactions via the internet and will not hold us responsible for any security breaches.

h. Kids4IT may supplement the information you provide with information we receive from third parties, such as examination boards or your employer.

Copyright

Course materials and projects are protected by copyright law and may not be reproduced, lent, or shared with third parties.

Intellectual Property

a. All intellectual property rights in course materials, online courses, and lectures delivered by instructors during the courses are and remain the intellectual property of Kids4IT or its licensors, whether adapted, written, or customized for the client or not.

b. You are not authorized to:

(i) copy, modify, reproduce, republish, sublicense, sell, upload, broadcast, post, transmit, or distribute any course materials without prior written permission;

(ii) record the online course or in-person course on video or audio tape, via videophone, or by any other means;

(iii) use the course materials in the provision of any other course or training, whether offered by us or any third-party instructor;

(iv) remove any copyright or other Kids4IT notices from the course materials;

(v) modify, adapt, combine, translate, disassemble, decompile, or reverse engineer (except to the extent permitted by law) any software included in the online courses.

Violation of this clause will allow us to immediately terminate these terms and conditions and cease providing any Services to you, including, but not limited to, access to online courses.

c. Considering the fees you have paid, we grant you a limited, non-transferable, non-exclusive license to use the course materials and software for the online course solely for the purpose of completing the online course and/or participating in the in-person course.

Termination

We reserve the right to terminate these Terms and Conditions and to immediately cease providing any Services if you:

  • Fail to pay fees when due;
  • Act in an aggressive, offensive, threatening, or harassing manner toward any Kids4IT employee, instructor, or student participating in any course;
  • Cheat or plagiarize any work you are required to prepare or present in connection with the Services or during any examination related to the Services;
  • Steal from or act fraudulently or deceptively toward us, our employees, or any other students on our premises or participating in our courses;
  • Intentionally or recklessly damage our property, the property of our employees, or the property of other students attending our premises;
  • Be under the influence of alcohol or illegal drugs on our premises;
  • Commit any criminal offense on our premises or where the victim is our employee or student;
  • Violate these Terms and Conditions.
